Consequently, it’s crucial to review and update your estate plan periodically to reflect these changes and ensure it still meets your needs.”
What type of trust would you recommend for someone just starting their estate planning journey?
“For many individuals beginning their estate planning, a Revocable Living Trust is an excellent choice,” Steve explained. “This type of trust allows you to maintain control over your assets during your lifetime while avoiding the time-consuming and costly probate process after you pass away.”
Steve elaborated on the advantages of a Revocable Living Trust: “Ordinarily, with a revocable living trust, you can change the terms of the trust or even dissolve it entirely as long as you’re alive and mentally competent. Moreover, assets held in a revocable living trust are generally not subject to probate, meaning they can be distributed to your beneficiaries more quickly and privately.”
He shared an experience, saying, “I once worked with a client who had diligently created a will but hadn’t considered a trust. After her passing, her family faced a lengthy and expensive probate process. Had she established a revocable living trust, her assets could have been distributed to her heirs much more efficiently.”
“According to the American Bar Association, over 50% of Americans die without a valid will or estate plan,” Steve stated. “This can lead to unintended consequences and family disputes during an already difficult time.”
