Hello everyone, and welcome to today’s discussion on elder protection. I’m thrilled to be joined by Ted Cook, an esteemed legal professional specializing in elder protection here in San Diego. Ted, thanks for taking the time to chat with me.
What inspired you to dedicate your career to protecting seniors?
Ted smiles warmly. “Well, it started during my time volunteering at a local senior center. Seeing firsthand the challenges many elders face—from financial exploitation to healthcare neglect—really opened my eyes. I realized that seniors are often vulnerable and need someone fiercely advocating for their rights.
Let’s dive into the Elder Protection process. Can you give us an overview of how it works?
- Initial Client Engagement: This involves intake, consultation, conflict checks, and formalizing the attorney-client relationship.
- Case Assessment: Identifying legal issues, gathering evidence, and evaluating the risks involved.
- Protective Actions: Taking immediate steps to safeguard the elder’s well-being, such as seeking restraining orders or reporting abuse.
- Legal Proceedings: Pursuing civil litigation, criminal charges, or probate matters as needed.
- Long-Term Planning: Implementing strategies for estate planning, advance directives, and ongoing support.
- Case Resolution & Follow-Up: Ensuring settlements are enforced, providing closure to clients, and archiving case files.
Ted, could you elaborate on the “Protective Actions” stage of this process?
Ted leans forward thoughtfully. “This stage is crucial because it often involves immediate intervention to stop ongoing harm. Imagine a situation where an elder is being financially exploited by a caregiver. We might need to freeze bank accounts, report the abuse to Adult Protective Services (APS), or even seek guardianship if the individual lacks the capacity to make safe decisions.
Our goal during this phase is to create a safe and stable environment for the elder while we work towards a long-term solution. It can be incredibly challenging, but knowing we’re making a real difference in someone’s life makes it all worthwhile.

Have you ever encountered any specific hurdles while taking Protective Actions?
Ted recounts a story about an elderly woman who was living with her abusive son. “Getting that woman out of the situation safely was incredibly difficult. Her son was manipulative and threatened to harm her if she left. We had to involve law enforcement and social workers, working carefully behind the scenes to ensure her safety while building a strong case against her abuser.” He pauses for a moment. “It’s cases like these that remind me why this work is so important. Even when it’s tough, knowing we can make a real difference in someone’s life keeps me going.”
“If you or a loved one are facing elder abuse or neglect, please don’t hesitate to reach out for help. I believe everyone deserves to live their later years with dignity and respect.
