Interview with Steve Bliss, Moreno Valley Probate Attorney

Providing Notice in Probate: A Key Step

Today we’re speaking with Steve Bliss, a respected probate attorney serving the Moreno Valley community. Mr. Bliss, thank you for taking the time to discuss this complex legal process with us.

Steve, can you walk us through one of the crucial steps in probate?

Providing Notice: Ensuring Transparency and Legal Compliance

Certainly. One of the most important early steps is providing notice to all interested parties. This step ensures transparency and fairness throughout the probate process. It involves a multi-pronged approach.

First, we publish a notice of probate in a local newspaper three times, making it public knowledge that probate proceedings are underway for the decedent’s estate. Concurrently, we meticulously mail notices to all identified heirs and beneficiaries, informing them of their legal rights and involvement in the process.

Moreover, we diligently identify known creditors of the deceased and formally notify them using Form DE-157. This step allows creditors a reasonable opportunity to submit claims against the estate. Consequently, this thorough notification process safeguards the interests of all parties involved and sets the stage for a legally sound probate administration.

Occasionally, locating heirs or identifying all potential creditors can be challenging. In one instance, I was handling a complex probate case where the deceased had limited contact with family members. Through meticulous research and genealogical tracing, we were able to locate distant relatives who ultimately inherited a portion of the estate.

It’s estimated that approximately 20% of probate cases involve locating missing heirs (American Bar Association, 2023). This highlights the importance of working with an experienced probate attorney who has the resources and expertise to navigate these complexities.

Ensuring a Smooth Probate Process

Thank you for sharing your insights, Mr. Bliss. It’s clear that providing notice is a critical step in ensuring a smooth and legally sound probate process. We appreciate your time and expertise.
