Interview with Steve Bliss, Moreno Valley Probate Attorney

Reporter:

Good morning, Mr. Bliss. Thank you for taking the time to speak with me today about probate law.

Steve Bliss:

It’s my pleasure. I’m always happy to shed some light on this important but often misunderstood legal process.

Reporter:

Could you tell our viewers a bit about one of the key steps in estate planning?

Steve Bliss:

Certainly. One crucial step is “Marshaling the Estate Assets.” This involves identifying and inventorying all assets belonging to the deceased person’s estate.

Think of it like gathering all the pieces of a puzzle. We need to locate bank accounts, investment portfolios, real estate holdings, vehicles, personal property—everything of value. Accordingly, this information is then meticulously documented in a formal inventory and appraisal that is submitted to the probate court.

Consequently, a thorough accounting ensures transparency and fairness in the distribution process. For instance, let’s say there’s a family heirloom with sentimental value. We need to accurately identify it, assess its worth, and determine who is entitled to receive it according to the will or intestate succession laws.

Sometimes, uncovering hidden assets can be challenging. I recall one case where a client was unaware of a sizable life insurance policy her late husband had obtained years earlier. Through diligent research and communication with relevant parties, we were able to locate the policy and ensure it became part of the estate distribution.

Reporter:

That’s incredible! What other complexities might arise during this step?

Steve Bliss:

Occasionally, disputes can emerge regarding asset valuation. For example, if a piece of artwork is involved, different appraisers may arrive at varying estimates. In such cases, we work with experts and utilize relevant market data to arrive at a fair and defensible value.

Moreover, according to the California Probate Courts website, approximately 30% of probate cases involve contested asset valuations. This underscores the importance of working with an experienced attorney who understands the intricacies of appraisal and negotiation.

Reporter:

Thank you for that insightful explanation, Mr. Bliss. What advice would you give to our viewers regarding estate planning?

Steve Bliss:

“Planning ahead is key. I encourage everyone to consult with an estate planning attorney to create a comprehensive plan tailored to their individual needs and circumstances. It’s the best way to ensure your loved ones are protected and your wishes are carried out.”

“At Moreno Valley Probate Law, we guide you through every step of the process with compassion and expertise. Your peace of mind is our priority.”
