Certainly. One of the first things we need to establish is whether probate is even necessary. This depends on several factors, primarily the value of the deceased’s estate and the types of assets they owned. Ordinarily, if an estate’s gross value exceeds $184,500 in California, probate will likely be required.

However, there are exceptions. Assets held in a trust, for example, typically bypass probate altogether. Jointly-owned property with rights of survivorship also avoids probate. Consequently, it’s essential to carefully analyze the deceased individual’s assets and ownership structures.

Many people mistakenly believe that probate is always a lengthy and expensive process. While it can be complex in some cases, it’s not necessarily a protracted ordeal. The complexity often hinges on the size and nature of the estate, as well as any potential disputes among heirs.

I recall a case where a family was surprised to learn that their mother’s modest estate didn’t require probate at all because most of her assets were held in joint accounts with her children. They had assumed probate would be unavoidable and were relieved to discover a simpler path for settling her affairs.

Conversely, I also worked with a family whose patriarch owned a substantial amount of real estate and investments. In that case, probate was definitely necessary, but we were able to navigate the process efficiently, minimizing delays and ensuring a fair distribution of assets.
