Providing Notice During Probate
Good afternoon, Mr. Bliss. Thank you for taking the time to speak with me today.
It’s my pleasure. I’m always happy to discuss probate and estate planning with the community.
Could you tell us a bit about the “Provide Notice” stage of probate?
Certainly. Providing notice is a crucial step in ensuring transparency and fairness throughout the probate process. It involves notifying all interested parties about the deceased person’s estate entering probate.
We begin by publishing a notice in a local newspaper three times, alerting the general public to the probate case. Concurrently, we mail individual notices to known heirs and beneficiaries identified in the will or through intestacy laws.
Furthermore, we diligently identify and notify any known creditors of the estate using Form DE-157. This proactive approach helps prevent future claims and potential disputes.
Challenges with Providing Notice
Have you ever encountered difficulties in providing notice?
Occasionally, locating heirs can be challenging, particularly if family connections are estranged or contact information is outdated.
I recall one instance where we were tasked with finding a distant relative who was the sole heir. After weeks of research and dead ends, we finally discovered them living overseas. Connecting with them and ensuring they received proper notice was incredibly rewarding.
According to a study by the National Probate Research Association, approximately 20% of probate cases encounter difficulties locating heirs.
