An irrevocable trust, as the name implies, cannot be easily changed or dissolved once it’s created. Consequently, this offers significant advantages in terms of asset protection and estate tax planning. When assets are placed into an irrevocable trust, they are generally removed from the grantor’s taxable estate. This can be especially beneficial for individuals with substantial assets who are looking to minimize potential estate taxes.

Moreover, an irrevocable trust can provide a layer of protection against creditors. Since the grantor no longer technically owns the assets within the trust, they are less susceptible to claims from creditors. Conversely, revocable trusts offer more flexibility during the grantor’s lifetime but don’t provide the same level of asset protection.

Ordinarily, irrevocable trusts are used for complex estate planning strategies. They can be structured in various ways to meet specific needs, such as protecting assets for a spouse with special needs or ensuring that inheritance is distributed according to the grantor’s wishes even after their passing.
