Let’s delve into one specific step: “Handle Debts and Taxes.” What does this entail?
This is a crucial stage where we ensure all the deceased person’s financial obligations are met before distributing assets. We carefully review any outstanding debts, loans, credit card bills, and utility payments. Accordingly, we prioritize paying valid creditor claims to avoid potential legal complications later on. Moreover, we work closely with tax professionals to accurately file and pay both state and federal taxes on behalf of the estate.
It’s a meticulous process that requires attention to detail and a thorough understanding of tax laws. The Internal Revenue Service reports that approximately 90% of estates require some form of tax filing, highlighting the importance of this step.
Notwithstanding our best efforts, there have been instances where creditors presented claims long after the initial probate process was completed. I recall one case involving a family business where a supplier emerged with a significant outstanding invoice months after we had distributed assets to the heirs.
Fortunately, due to our meticulous record-keeping and documentation of all payments, we were able to successfully defend against the claim.
What advice would you give to someone going through probate for the first time?
